International Lawyers Defend Right of Israelis to Live in Judea and Samaria

A two state solution?  That's pretty much a fallen cause at the moment.  It was a nice thought; once, 2 states living next to each other-so much so that they touched, and living in peace and quiet.  It's a dream, now a nightmare. Fatah has united with the terrorists, Hamas in forming Palestine.
                                                                         
The Palestine that Hamas and Fatah jointly plan for in Judea, Samaria on the east side of Israel and Gaza on the West side want to be Judenrein, to have only Muslims, no Jews.  Yet we have a good 350,000 Jews living there now.

Called the "Settlements" by the uneducated,  many legal authorities like Eugene Rostow dispute the charge that they are illegal, or that Jews living there are breaking the law and are illegally living there.  Stephen Schwebel, another international legal scholar, notes that a country acting in self-defense may seize and occupy territory when necessary to protect itself.  He says that a state may require, as a condition for its withdrawal, security measures designed to ensure its citizens are not menaced again from that territory.

I'm talking about Judea and Samaria that were taken in 1967 when Arab nations attacked Israel in their greed to take the whole state, and instead lost to Israel, the winner.  By winning, Israel accidentally became heir to her own lost lands that went to Jordan in 1948 so now really has them back again, nice and legal, if the anti-Semites in the world would put on their be fair glasses.  This is the result of wanting another's property.  The Arabs wanted more and lost what they had held (illegally) of course.

Eugene Rostow, a former Undersecretary of State for Political Affairs in the Johnson Administration, found that Resolution 242 gives Israel a legal right to be living in Judea and Samaria, their ancient lands.  The resolution allows Israel to administer the territories it won in 1967 until a just and lasting peace in the Middle East is achieved.  He added, "speaker after speaker made it clear that Israel was not to be forced back to the fragile and vulnerable 1949 Armistice Demarcation Lines.

Israel's claim supersedes Jordan's claim wrote Rostow in 1977 because Jordan's presence in Judea and Samaria was the result of its aggression in 1948, while Israel's arose from the exercise of its legitimate right of self-defense.  The land had been earmarked as the Jewish Homeland by the League of Nations and by the United Nations.  80% of it was awarded to the Hashemite Kingdom for their fighting with Britain in WWI against the Axis.  What Britain had done was promise the same piece of land to both the Arabs and the Jews.  The Arabs reacted quickly when they saw Jews fighting their enemies in the War of Independence and took the land illegally.

Jews living there are NOT an obstacle to peace.  They were ostracized from there from 1949 to 1967.  During that time the Arabs refused peace plans with Israel.  From 1967 to 1977 the Labor Party had a few towns established yet the Arabs showed no interest in making peace.  By 1977, Egyptian President Sadat went to Jerusalem to make peace.  One year later, Israel  kept from building in Judea and Samaria, hoping the gesture would entice others to join the Camp David peace process.  None joined.

Regardless of what was going on, the Arabs did not want peace.

90% of the Jews living in Judea and Samaria are living in actual suburbs of the major Israeli cities such as Jerusalem and Tel Aviv.  These are areas that must be retained by Israel to ensure its security.  The whole purpose of any building program is for security reasons. The way Israel was chopped up in the 1920s makes it very hard to protect citizens.  Now Gaza's border is up against Israel with no space between.  In the past there has been heavy fighting in Judea-Samaria where Israel must retain to have security for the large cities.
This is most racist and is like saying that Jews cannot live in London, Paris or New York because the Arabs there don't want them.

Arabs, 1.7 million of them, are citizens of Israel.  Any peace settlement had to permit Jews to continue living in Judea and Samaria.  The British did the    un-American act when they held the mandate to declare large areas of Palestine as off-limits to Jews when they were supposed to help to create the Jewish Homeland.  Apartheid should not be allowed at all.  The irony is that anti-Semites keep saying that Israel is practicing Apartheid by being a Jewish state while they say nothing about the 49 Muslim majority countries, many of which do not allow Jews into their countries such as Saudi Arabia.
